A Case Management Agenda is a template document which the Tribunal sends to both you and the Respondent to fill in before the first Preliminary Hearing. It can save time if you can agree on what you say.

The Case Management Agenda document has lots of questions in it. There are two questions that you might think are the same, but they're very different, and it's easy to get them wrong. Let’s take a look:

Question 2.1: What are your claims? That would be something like unfair dismissal, constructive dismissal or direct race discrimination.

But in question 4.1, they ask, what are the issues or questions for the Tribunal to decide? It’s common for people to repeat their claims in this section, for example “Is this a constructive dismissal case?”

But that's not quite what the Tribunal are looking for. They want to understand the questions that are in dispute that the Tribunal needs to decide. For example, if it's an unfair dismissal case and you think that the process wasn't followed, then one of the questions might be, was this a fair process?
