How to figure out how much to settle for
Content / trigger warning
There's a lot of settling with employers going on right now. A lot of you are buying our without prejudice template and then getting in touch and asking "how do I figure out how much to ask for in the settlement?"
Here is a really quick tip for that.
A useful way to think about settling with your employer is that you're settling to avoid the risk of going to Tribunal and for them to lose the case and have to pay what the Tribunal would award.
So often people work backwards from what the Tribunal award would be.
When you're writing out your without prejudice letter, start with the claims that you think you would have at the Tribunal For example, unfair dismissal and discrimination on the basis of sex. Then you can just look for the way that they would calculate that award.
Unfair dismissal has online calculators. Discrimination typically has past loss, future loss and injury to feeling.
So search for the claim, then the calculation.
