Contributory fault

Contributory fault refers to a claimant contributing to their dismissal through their own behaviour or actions.

If an Employment Tribunal establishes contributory fault in an unfair dismissal case, the judge may reduce the claimant’s compensation to reflect this.

This can have a meaningful impact on the final award the claimant receives. If the Tribunal awards an ACAS uplift, for example, the percentage increase will only apply to the remaining award value.
