Strike out
“Strike out” refers to a judge’s decision to dismiss all or part of a claimant or respondent’s claim or defence in an Employment Tribunal case.
If the claimant or respondent believes the other party’s claim or defence meets one of the grounds outlined in the Employment Tribunal Rules of Procedure, they can submit a strike out application.
If the judge upholds the application, the other party’s claim or defence – or the relevant part of it – is struck out.
