If you’re bringing an employment tribunal claim for disability, you may be asked by the courts to provide a disability impact statement. This can feel daunting to create, especially if you are given a limited word count but rest assured we are here to help.
Valla can help you with reviewing your statement if you ever need any help.
What is a disability impact statement
A disability impact statement explains:
- the claimant’s physical or mental impairment;
- how long it has lasted or is expected to last;
- how it affects normal day-to-day activities; and
- how those effects would be without medication, treatment or other measures.
It helps the Employment Tribunal decide whether the claimant was disabled under section 6 of the Equality Act 2010 at the relevant time.
The statement should not assess the effects only when they are controlled by medication or treatment. It should explain, so far as possible, what the effects would be without those measures.
The statement should focus on the practical effects of the condition. It is not the same as a witness statement dealing with the whole case.
Disability status
Generally, a person is disabled under the Equality Act 2010 if they have:
- a physical or mental impairment;
- which has a substantial adverse effect;
- on their ability to carry out normal day-to-day activities; and
- which is long term.
“Substantial” means more than minor or trivial.
“Long term” generally means that the effect:
- has lasted at least 12 months;
- is likely to last at least 12 months; or
- is likely to last for the rest of the person’s life.
Recurring or fluctuating conditions may qualify if the substantial adverse effect is likely to recur.
