"No reasonable prospect of success"

“No reasonable prospect of success” is a phrase found in strike out applications and costs warning letters. 

It’s used when one party in the Tribunal proceedings argues that the other party’s claim or defence has absolutely no chance of being successful. 

If the judge agrees, they may strike out the relevant party’s case or ask the relevant party to pay the other party’s legal costs.  

However, if the judge believes a party’s claim or defence has even the slimmest prospect of success, no action will be taken.
